1. Acceptance of Terms
By accessing or using ActualPrice ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
ActualPrice provides AI-powered pricing intelligence for e-commerce merchants, including competitor price tracking, social sentiment analysis, and pricing recommendations. The Service integrates with Shopify and WooCommerce platforms to deliver actionable insights.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
4. Acceptable Use
You agree not to misuse the Service, including but not limited to: reverse engineering the platform, scraping data for resale, interfering with other users' access, violating any applicable laws, or using the Service to engage in anti-competitive pricing practices such as predatory pricing or price fixing.
5. Pricing & Billing
Paid plans are billed monthly or annually as selected at signup. Prices are listed in USD unless otherwise stated. We reserve the right to change pricing with 30 days notice. Early access and founder pricing, once locked in, will be honored for the lifetime of continuous subscription.
6. Pricing Recommendations Disclaimer
ActualPrice provides pricing recommendations based on data analysis and AI models. These are suggestions only—you are solely responsible for all pricing decisions made for your store. We do not guarantee specific revenue outcomes, profit increases, or competitive advantages. Market conditions can change rapidly and past performance does not predict future results.
7. Data & Intellectual Property
You retain ownership of your store data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing pricing intelligence. Our platform, AI models, algorithms, and interface design remain the intellectual property of ActualPrice.
8. Limitation of Liability
To the maximum extent permitted by law, ActualPrice shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, lost profits, or loss of data. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Termination
Either party may terminate the agreement at any time. You can cancel your subscription from your account settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be available for export for 30 days, after which it will be deleted.
10. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
11. Governing Law
These terms are governed by the laws of Canada. Any disputes shall be resolved in the courts of the Province of Quebec.
